DMCA Policy

Digital Millennium Copyright Act notice and takedown procedures.

Effective Date: Apr 15, 2026

ByteYogi respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA") and the Indian Copyright Act, 1957, we will respond promptly to claims of copyright infringement committed using our Website.

1. Our Commitment to Copyright Protection

We take copyright infringement very seriously. All content published on our Website, including articles, tutorials, code examples, images, and other materials, is either original content created by our team, content contributed by authorised guest authors, properly licensed content, or content used under fair use provisions.

If you believe that any content on our Website infringes upon your copyright, we encourage you to notify us using the procedure described below. We will investigate all valid notices and take appropriate action.

2. Filing a DMCA Takedown Notice

If you are a copyright owner, or are authorised to act on behalf of a copyright owner, and you believe that content on our Website infringes your copyright, please submit a written notification containing the following information to our Designated Agent:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list.
  2. Identification of the infringing material: Identification of the material on our Website that you claim is infringing, with enough detail so that we can locate it. Please provide the specific URL(s) of the page(s) containing the allegedly infringing material.
  3. Your contact information: Your full legal name, mailing address, telephone number, and email address.
  4. Statement of good faith belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  5. Statement of accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorised to act on behalf of the copyright owner.
  6. Signature: A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.

Please note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. If you are not sure whether material on our Website infringes your copyright, you may wish to contact a legal professional before filing a notification.

3. Designated Agent for DMCA Notices

All DMCA takedown notices should be sent to our Designated Agent at the following contact details:

Please include "DMCA Takedown Notice" in the subject line of your email to ensure prompt processing.

4. Our Response to Takedown Notices

Upon receipt of a valid DMCA takedown notice, we will take the following actions:

  1. Acknowledge receipt of the notice within 2 business days.
  2. Review the notice for completeness and validity.
  3. Promptly remove or disable access to the allegedly infringing material.
  4. Notify the content contributor (if applicable) that the material has been removed or disabled, and provide them with a copy of the takedown notice.
  5. Retain a record of the notice for our files.

If the notice is incomplete or does not meet the requirements of the DMCA, we may request additional information before taking action.

5. Counter-Notification Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Agent containing the following information:

  1. Identification of the removed material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled (please provide the specific URL).
  2. Your contact information: Your full legal name, mailing address, telephone number, and email address.
  3. Statement of good faith: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Consent to jurisdiction: A statement that you consent to the jurisdiction of the courts in India, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  5. Signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will:

  1. Promptly provide the original complainant with a copy of the counter-notification.
  2. Inform the original complainant that we will restore the removed material within 10 to 14 business days.
  3. Restore the removed material within 10 to 14 business days after receiving the counter-notification, unless the original complainant notifies us that they have filed a court action seeking to restrain the content contributor from engaging in infringing activity.

6. Repeat Infringers Policy

It is the policy of ByteYogi to terminate, in appropriate circumstances, the access of users and contributors who are repeat copyright infringers. If a user or contributor is found to have repeatedly infringed upon the copyrights of others, we will take reasonable steps to terminate their access to our Website and remove all infringing content.

We define a "repeat infringer" as any user or contributor against whom we have received more than two valid DMCA takedown notices. We reserve the right to terminate access after even a single instance of infringement if the circumstances warrant it.

7. Good Faith and Fair Use

Before filing a DMCA takedown notice, please consider whether the use of the material in question may be protected by fair use or fair dealing provisions under applicable copyright law. Fair use considerations include the purpose and character of the use, the nature of the copyrighted work, the amount and substantiality of the portion used, and the effect of the use upon the potential market for the copyrighted work.

As an educational technology publication, much of our content involves discussing, analysing, and explaining technology concepts, which may involve referencing or quoting from other sources within the bounds of fair use and fair dealing provisions.

8. Indian Copyright Law

In addition to the DMCA, we comply with the Indian Copyright Act, 1957, and the Information Technology Act, 2000. Under Section 52 of the Indian Copyright Act, certain acts, including fair dealing for the purpose of private or personal use including research, criticism, or review, are not considered infringement. Under Section 79 of the Information Technology Act, we operate as an intermediary and comply with the provisions related to intermediary liability and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

If you are a copyright owner in India and believe your copyright has been infringed, you may also file a complaint under the applicable provisions of Indian law. We will cooperate fully with any legal proceedings related to copyright infringement.
